What you Need to Know:

An examination under oath (often called an “EUO”) is a formal proceeding where an insurance company lawyer asks you questions under oath about your insurance claim. Most insurance policies contain a provision that allows insurance companies to demand your EUO to investigate your claim. Insurance companies routinely request a long list of documents and records before your EUO occurs so that they can ask you questions about the documents you provide. An EUO usually lasts several hours, and the entire proceeding is recorded and typed up by a court reporter.

What to Expect During an Examination Under Oath: 

Insurance companies demand EUOs and documents from you so they can try to reduce or eliminate your claim or frustrate you into giving up on your claim. Prior to your EUO, the insurance company lawyer will prepare an extensive list of questions to ask you about your property and your claim. You will feel like you’re being interrogated because, you are. The lawyer will likely ask you the same question multiple times to trip you up. The lawyer will probably ask you many questions that are completely irrelevant to your claim to harass you. It’s all part of the insurance company’s strategy to deny, underpay, and delay your claim.
